Terms and Conditions of Service
Please read these Terms and Conditions carefully before using the Willwise service. By accessing our website or using our service, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you should not use the service.
1. About Willwise
Willwise (willwise.ie) is operated by Alan Browne a sole trader registered in Ireland ("Willwise", "we", "us" or "our"). Our registered address is No 48 Howth Lodge Howth D13RX06. You can contact us at support@willwise.ie
2. Nature of the Service
Willwise provides an online will-writing questionnaire and related support to assist you in preparing a draft will document. Specifically, our service includes:

A guided digital questionnaire to capture your instructions and wishes

Generation of a draft will document based on your responses

Access to support during and after the completion process

Assistance with amendments to your will document following completion
IMPORTANT: Willwise is not a firm of solicitors and does not provide legal advice. We are not regulated by the Law Society of Ireland. The service is a document-preparation and support service only.
We strongly recommend that you seek independent legal advice from a qualified solicitor if your circumstances are complex, if you have assets in multiple jurisdictions, if you are concerned about potential challenges to your will, or if you have any doubt about whether this service is suitable for your situation.
3. Eligibility
To use the Willwise service you must:

Be aged 18 or over

Be habitually resident in the Republic of Ireland

Have the mental capacity to make a will

Be making a will voluntarily and without undue influence from any third party
By using the service you confirm that all of the above apply to you. If you are in doubt about whether you have testamentary capacity, please seek independent legal or medical advice before proceeding.
4. Your Responsibilities
You are solely responsible for:

The accuracy and completeness of all information you provide through the questionnaire

Ensuring that your will is executed correctly — signed by you in the presence of two independent witnesses who are also present at the same time, and who are not beneficiaries under the will or spouses/civil partners of beneficiaries

Storing your signed will safely and ensuring relevant persons are aware of its location

Updating your will if your circumstances change (including marriage, civil partnership, divorce, the birth of children, or significant changes to your assets)
A will that is not correctly executed is not legally valid. Willwise provides guidance on execution requirements but cannot verify that your will has been correctly signed and witnessed.
5. Amendments
Following initial delivery of your will document, you may request amendments to reflect changes in your circumstances or wishes. Amendments are subject to the following:

Minor amendments (changes to beneficiaries, executors, specific bequests) are included within the service fee for a period of 14 days from the date of delivery

Amendments requested outside this period, or amendments requiring substantial redrafting, may be subject to an additional fee, which will be communicated to you in advance

Where an amendment materially changes the structure of your will, we may advise you to consider a new will rather than a codicil
6. Fees and Payment
The fee for the Willwise service is as stated on our website at the time of your order. All fees are inclusive of VAT where applicable. Payment is due in full before delivery of your completed will document.
We reserve the right to amend our pricing at any time. Changes will not affect orders already placed and paid for.
7. Cooling-Off Period and Refunds
Under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013, you have a right to cancel your order within 14 days of purchase without giving a reason (the "cooling-off period").
However, if you request that we begin work on your will document before the 14-day period has expired — which we will take as having occurred once you submit your completed questionnaire — you acknowledge that your right to a full refund will be lost upon delivery of the completed document. You will remain entitled to a proportionate refund if you cancel before delivery.
To exercise your right to cancel, contact us at support@willwise.ie stating your order reference and your wish to cancel.
8. Limitation of Liability
To the fullest extent permitted by Irish and EU law:

Willwise shall not be liable for any loss arising from errors or omissions in the information you provide

Willwise shall not be liable for the invalidity of any will arising from incorrect execution, supervening events (such as marriage), or changes in law

Willwise shall not be liable for any indirect, consequential or economic loss arising from use of the service

Our total liability to you in connection with the service shall not exceed the fee paid by you for the service
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under Irish law.
9. Intellectual Property
All content on willwise.ie, including the questionnaire, templates, guidance text and supporting materials, is the property of Willwise and is protected by applicable intellectual property laws. You may not copy, reproduce or distribute any part of the service without our prior written consent.
The will document generated for you is yours to use for your personal purposes. You may not use it as the basis of a commercial service.
10. Data Protection and Privacy
We process your personal data in accordance with our Privacy Policy, available at [LINK], and in compliance with the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988–2018.
Given the sensitive nature of the information involved in will-writing, we take data security seriously. We will never sell your personal data to third parties. Please review our Privacy Policy for full details of how we handle your data, your rights, and how to contact us with data protection queries.
11. Complaints
If you are unhappy with any aspect of the service, please contact us in the first instance at support@willwise.ie We will acknowledge your complaint within 2 business days and aim to resolve it within 10 business days.
As Willwise is not a regulated legal services provider, complaints about the quality of legal advice fall outside the remit of the Law Society of Ireland. However, your statutory consumer rights under Irish and EU law remain unaffected by these Terms.
12. Changes to These Terms
We may update these Terms from time to time. The current version will always be available at willwise.ie. Continued use of the service after changes are posted constitutes acceptance of the revised Terms. We will notify existing customers of material changes by email where practicable.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising in connection with these Terms or the service shall be subject to the exclusive jurisdiction of the Irish courts.
