In the event of any disputes that cannot be resolved through our complaints process, the courts of Ireland will have jurisdiction, and Irish law will govern the interpretation and enforcement of these terms.

3. The Words We Use in This Document

 

In this document, “we”, “us”, and “our” refer to WillWise Trustees Limited.

The terms “you”, “your”, “I”, and “my” refer to the individual appointing WillWise as executor and trustee.

“Executor Services” refers to WillWise Trustees Limited’s role in managing your estate, or another appointed party acting on our behalf as executor and trustee.

 

4. Who Can Appoint Us as Executor and Trustee

 

To appoint us, you must:

• Be 18 years or older

• Be able to navigate our online platform independently

• Understand the documents we send without external assistance

• Require a will valid for use under Irish law

• Be a permanent resident of Ireland

 

5. What Happens Upon Your Passing

 

Upon receiving the necessary documents, we will conduct a free initial assessment of your estate. This will help us determine whether it is necessary or appropriate for us to act as executor and trustee. Our review includes:

• Determining if probate is required

• Assessing any disputes related to the estate

• Evaluating the estate’s value and potential tax obligations

• Considering whether a professional executor is needed

• Identifying any children or trusts included in the will

• Reviewing requests for us to step down in favor of a suitable alternative executor

If, after our assessment, we determine that it’s not suitable for us to act, we will step down at no cost to your estate and assist with the necessary paperwork.

 

6. Following Our Assessment of Your Estate

• If We Step Down: We will complete any required documentation at no cost.

• If We Continue to Act: Our Executor Services will be provided under the terms in place at the time of your death. These terms will be shared with your beneficiaries before we begin any work.

• Subcontracting: We may appoint third parties to assist with aspects of your estate administration. Their services will be subject to their terms at the time.

 

7. Fees

• If We Step Down: There will be no fees charged for us stepping down as executor.

• If We Act as Executor: Our fees will be based on the complexity of the estate and shared with your beneficiaries or co-executors before any work starts.

• Third-Party Assistance: Any third-party fees will also be shared with your co-executors or beneficiaries.

 

Our fees include:

• A fixed fee for our probate service, based on the complexity of your estate

• An administrative fee for acting as executor and trustee

9. How You Can Cancel

 

Before your death, you can update your will to appoint a different executor or trustee.

After your death, if your co-executors or beneficiaries do not want WillWise to act, they can contact us at support@willwise.ie. If we’ve already started providing services, certain fees may apply for work completed up to that point.
